1. Introduction
1.1 Welcome to AppointWise. These Terms and Conditions ("Terms") govern your use of our cloud-based appointment software ("Service").
1.2 By accessing or using our Service, you agree to abide by these Terms and our Privacy Policy, which is incorporated herein by reference.
2. Free Trial
2.1 AppointWise offers a 2-week free trial for new users. During this period, users can access all features of the Service without charge.
2.2 To initiate the free trial, users are required to provide valid payment details.
2.3 Users may cancel the free trial at any time. If not cancelled by the end of the 2-week period, users will automatically be moved to a paid subscription and charged accordingly.
3. Subscription & Payment
3.1 Following the free trial, a subscription fee will apply to continue using the Service. By providing payment details, you agree that you will be automatically charged for the subscription at the end of the free trial unless canceled.
3.2 All subscription payments are non-refundable under any circumstances, except where required by applicable UK consumer law. You agree to ensure that your payment details are up-to-date and that you are able to cover the subscription fees. Failure to pay may result in the suspension or termination of your account.
3.3 By purchasing a subscription, you acknowledge that the service is provided "as-is" and "as-available" without any warranty or guarantee. You understand and agree that no refunds or chargebacks will be issued for dissatisfaction with the service unless we are legally obligated.
3.4 AppointWise uses third-party payment processors for all transactions. By using our Service, you agree to the terms and conditions of these processors. You acknowledge that disputes regarding transactions will be handled by the payment processor in accordance with their policies, and you waive any right to initiate a chargeback with your bank or credit card provider.
4. Termination
4.1 Users may cancel their subscription at any time through their account settings, but charges already incurred will not be refunded.
4.2 AppointWise reserves the right to terminate or suspend any account without prior notice if the user breaches these Terms or any applicable laws.
5. Data & Privacy
5.1 By using AppointWise, you consent to our collection, storage, and use of your data as outlined in our Privacy Policy.
5.2 By making an account, you accept the Terms and Conditions that we can store all forms of data received from you, including your GHL data such as addresses and phone numbers, to allow the AI to store conversations in order to generate responses.
5.3 AppointWise implements security measures compliant with UK regulations to protect your data.
6. Limitation of Liability
6.1 To the fullest extent permitted by applicable law, AppointWise will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangibles.
6.2 Our total liability for any claim arising out of or relating to these Terms or our Service shall not exceed the amount paid by you in the 12 months preceding the claim.
7. Changes to the Terms
7.1 We may update these Terms from time to time. Users will be notified of any major changes.
7.2 Your continued use of the Service after changes to the Terms indicates your acceptance of those changes.
8. Governing Law
These Terms are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales.
9. Dispute Resolution
9.1 In the event of a dispute, both parties agree to attempt to resolve the matter amicably before pursuing legal action.
9.2 Any legal proceedings arising from the use of our Service or relating to these Terms shall be resolved in the courts of England and Wales.
